Jusctice System


Problem:

The real problem is that we have a "Criminal System" and not a Justice System.



Solution:

Return America to a system of Justice. With the proper placement of this Justice & Crime domino, the impact from Steps #1-3 will hit this one to correct the criminal activity in the other problem areas of out nation.



Currently:

Americans reward criminal activity with, Plea-bargaining, a "money walks and poverty pays" attitude, an incarcerated life of leisure, and immunity to many who receive confessions of criminal pursuits.



Proposed Amendments:

1) If our present legislative branch does not begin enforcing Constitutional Amendment #13 which demands the punishment of crime with involuntary servitude, the People reserve their right to abolish the legislative branches of government and assume those powers for themselves.

2) Institute a nation-wide ban on plea-bargaining. The only acceptable deal is that the accused shall receive an impartial jury trial, and if convicted by the jury, they will serve 100% of their sentence in labor camps until the sentence is complete or an appeal finds them wrongly convicted. End of deal.

3) The governing individuals must be held to the same standards and penalties as those enforced upon the governed People. By its very nature, the payments of fines is unconstitutional in that it allows some of society to buy their way out of punishment. As a result, just penalties are the service of time in labor camps. In this way, all people pay the same price in time for similar offenses.

4) Forced Labor Camps are constitutional, according to Amendment #13. The balance against Amendment #8's "cruel and unusual punishment" is whether a Free American citizen does the same type of work for hire or as a volunteer. If so, that labor is just punishment for crime. As for how many hours can be forced on the convict, the same measure applies. Do Free Americans work that type of labor 6, 8, 12, or even 18 hours in a day? If so, those same hours are just punishment for criminal behavior.

5) Prohibition of the death penalty is necessary in a system known for wrongful accusations, wrongful convictions, and wrongful deaths. Labor camps, even for the most horrific of crimes benefits society thrice, once for not becoming like the criminal, twice for reaping the benefits of labor from the convicted, and thrice by being allowed to compensate the person in some measure if later discoveries prove the person innocent.

6) Punishment for people who knowingly provide false testimony shall be up to 1/2 the penalty the actual crime. This does not reduce the penalty of the person convicted of the crime. 

7) Monetary compensation and release shall be provided to those later exonerated of the crimes for which they were incarcerated. Monetary compensation shall be equal to $2 over the minimum wages at the time of release, paid for every hour of wrongful incarceration. Benefits payable to existing family if proof comes after death.

8) Restoration to Victims shall include monetary damages for property loss. A set amount of cash shall be determined as compensation for death by criminal action. Though never able to replace the life, the financial hardships can be lessened to some degree.

9) Repeal the professional immunity privilege presently enjoyed by the clergy, lawyers, doctors, family member, and others. In a Just system, all are responsible to insure the correct person is accused, tried and found guilty. Once ratified, anyone known to have received such a confession and fails to notify authorities within 24 hours, if able, shall be tried as an accomplice.

10) All person shall enjoy the privilege of using the insanity plea without objection. By entering such a plea, the accused shall be sentenced such as the normal penalty provides, and shall serve the entire sentence in labor camps. The accused shall bare the burden of proof that they are no longer insane in order to return to society. The reasoning: if society releases a self-confessed insane person back into society before they are credibly sane, society deserves any future criminal activity from the individual.

11) Victimless crimes shall no longer exist within the Unites States of America. Those presently serving time for such activity shall be released from such sentences but remain bound for other criminal activity until such sentences are completed. Society may regulated the activity for the safety of society with appropriate license fees attached to the activity. 





Required Action:

Try to persuade your legislators to enforce these suggestions. If they refuse, the People have the option of eliminating the legislative branches from government and re-possessing those powers.
